A couple weeks ago, we received some interesting news. Big news. From a big law firm, representing a big candy company.
They claim that our little ice cream biz, MilkMade Ice Cream (that’s us, below),

is infringing upon a brand of caramel candy owned by the third largest candy manufacturer in the United States (below).

They demand that we cease and desist our operations because “the relevant consuming public is likely to conclude that [our] products originate from or are affiliated with or sponsored by [theirs].“ On top of all that, they demand we hand over our website domain per the Anticybersquatting Consumer Protection Act.
So what now? Well, we think the likelihood of confusion among consumers is arguably impossible. The consuming public can surely tell the difference between

So from a business point of view - opportunity! We’ve already reached out to both the President and the Brand Managers at Brach’s to try turn this conflict into a great opportunity - a MilkMade & Milk Maid Caramel Ice Cream. We’ll break our local-sustainable-only rule just this once to use their caramels in our ‘scream. We help reinvigorate their brand, we keep our name, and we show the world that Big Caramel and the little guy can work together.
